A.    PURPOSE & BENEFITS   목적과 효익

JT International Korea Inc. (the “Company”) implements and operates this Personal Information Management Policy for retailers (this “Management Policy”) in accordance with the Personal Information Protection Act in order to protect personal information and the rights of the subjects of relevant personal information (the “Information Subject”) and smoothly handle and manage complaints raised by the Information Subjects.

제이티인터내셔널코리아주식회사 (이하 “회사 ”라 합니다) 는 개인정보보호법에 따라 정보주체의 개인정보 보호 및 권익을 보호하고 개인정보와 관련한 정보주체의 고충을 원활하게 처리할 수 있도록 다음과 같은 소매인용 처리방침을 두고 있습니다.

This policy applies to the Information Subject (Retailers).

본 정책은 정보주체 (소매인)에게 적용됩니다.

Article 1. Purpose of Processing Personal Information and the Contents thereof       

제1조   (개인정보의 처리 목적 및 항목)

 

① The Company shall process personal information of retailers as follows.  The Company shall not use any personal information which the Company processed for purposes other than those described below, and shall obtain consents from the Information Subject if and when the purpose of use is changed.

회사는 다음과 같이 소매인의 개인정보를 처리하고 있습니다. 처리한 개인정보는 다음의 목적 이외의 용도로는 사용되지 않으며 이용 목적이 변경될 시에는 정보주체의 동의를 구할 것입니다.

② The Company shall collect personal information for the purpose of achieving the aforementioned purposes of processing of personal information in the following manner:

회사가 상기 개인정보 처리 목적 달성을 위해 개인정보를 수집하는 방법은 다음과 같습니다.

 

§  Directly collect from the Information Subjects offline, online (eShop) registration or via e-mail

오프라인, 온라인 (eShop) 또는 이메일을 통하여 정보주체로부터 직접 수집

§  Directly collect from the Information Subjects  by providing service, purchasing information input and customer center phone calls

서비스 이용 , 구매정보 입력, 고객센터 전화를 통하여 정보주체로부터 직접 수집

§  Collect through documents with regard to business transactions and provision of services

비즈니스 거래 및 서비스 제공에 관한 문서를 통한 수집

 

Article 2 . Processing and Maintaining Period of Personal Information

제2조 (개인정보의 처리 및 보유 기간)

 

The personal Information shall be maintained and used for seven years from the date of withdrawal of the membership in eShop and 10 years from the date of termination of the off-line contract between the Information Subject and Company, and shall be destroyed when the purposes are achieved unless any obligation to preserve the pers onal information is provided under applicable laws and regulations, or the Information Subjects agreed otherwise.

소매인의 개인정보 : 정보주체 개인정보는 정보주체가 eShop을 통한 회원가입시 회원 탈퇴일로부터 5년간 , 정보주체와 회사 간 오프라인 계약 체결시 계약이 종료한 날로부터 10년간 보유·이용될 것이며, 법령에 따라 해당 개인정보를 보존해야 하는 의무가 존재하거나 정보주체들이 별도로 동의하지 않는 이상, 처리목적이 달성되면 파기됩니다.

 

Article 3. Provision of Personal Information to Third Parties

제3조 (개인정보의 제3자 제공)

 

The Company shall process the personal information of the Information Subjects within the scope as set forth in Article 1 in principle, and shall not process or provide a third party with any personal information beyond the scope originally intended unless the relevant Information Subject consents thereto or otherwise specified in the applicable laws.
회사는 원칙적으로 정보주체의 개인정보를 제1조에서 명시한 범위 내에서 처리하며 , 정보주체의 동의가 있는 경우 또는 법령의 규정에 따른 경우 외에는 본래의 범위를 초과하여 처리하거나 제3자에게 제공하지 않습니다 .

 

Article 4 . Outsourcing of Processing of Personal Information

제4조 (개인정보처리 위탁)

② Upon entering into an agreement on outsourcing of processing of personal information, the Company shall specifically set forth the matters, including without limitation compliance with applicable laws and regulations which are related to the protection of personal information, prohibition of provision of personal information to a third party and allocation of liabilities, and maintain the terms and conditions of relevant agreement.  In case of change of the outsourcing organization, the Company shall notify such change through its Personal Information Management Policy.

회사는 위탁계약 시 개인정보보호 관련 법규의 준수, 개인정보에 관한 제3자 제공 금지 및 책임부담 등을 명확히 규정하고, 당해 계약내용을 보관하고 있습니다. 수탁기관이 변경될 경우에는 개인정보처리방침을 통해 고지하겠습니다.

Article 6. Rights and Obligations of Information Subjects, and Performance thereof

제6 조 ( 정보주체의 권리 , 의무 및 그 행사방법)

 

① Any Information Subject may request for inspection and/or suspension of processing of his/her personal information or the personal information of his/her child under 14 years old; provided, that the Company may refuse such request by notifying the Information Subject of the reasons for the refusal in any of the following cases:

정보주체는 자신 및 14세 미만 아동의 개인정보의 열람 및 처리정지를 요구할 수 있습니다. 다만 다음의 어느 하나에 해당하는 경우에는 회사는 해당 사유를 정보주체에게 알리고, 처리정지 요구를 거절할 수 있습니다.

 

§  Where there is a special provision in applicable laws, or it is inevitable to process such personal information in order to comply with obligations provided under applicable laws;

법률에 특별한 규정이 있거나 법령상 의무를 준수하기 위하여 불가피한 경우

§  Where it is likely to harm the life or body of a third party, or unfairly damage properties and/or other profits of a third party; or

다른 사람의 생명· 신체를 해할 우려가 있거나 다른 사람의 재산과 그 밖의 이익을 부당하게 침해할 우려가 있는 경우

§  Where it is difficult to perform a relevant contract (e.g., failure to provide contemplated services to the Information Subject) without processing relevant personal information, and the Information Subject has not explicitly expressed his/her intention to terminate the contract.

개인정보를 처리하지 아니하면 정보주체와 약정한 서비스를 제공하지 못하는 등 계약의 이행이 곤란한 경우로서 정보주체가 그 계약의 해지 의사를 명확하게 밝히지 아니한 경우

 

② Any Information Subject may demand to correct or delete any errors in his/her personal information or the personal information of his/her child under 14 years old; provided, however, that the Information Subject cannot demand to delete the personal information if such personal information is set forth as information to be collected under applicable laws.

정보주체는 자신 및 14세 미만 아동의 개인정보의 오류에 대한 정정 및 삭제를 요구할 수 있습니다. 다만, 다른 법령에서 그 개인정보가 수집 대상으로 명시되어 있는 경우에는 그 삭제를 요구할 수 없습니다.

 

③ If the Information Subject demands to delete or correct any errors in the personal information, then the Company shall not use or provide such personal information until the correction or deletion is completed.  In addition, the Company shall immediately rectify wrongful use or provision of personal information upon detecting the same.

정보주체가 개인정보의 오류에 대한 정정 및 삭제를 요청한 경우에는 정정 및 삭제를 완료할 때까지 당해 개인정보를 이용 또는 제공하지 않습니다. 또한 잘못된 개인정보를 이용 또는 제공한 경우 발견 즉시 지체 없이 수정하겠습니다.

 

④ The Information Subject may exercise his/her rights of inspecting and demanding to suspend processing of personal information as set forth in Paragraph 1 through his/her legal representative or a proxy.  In such case, a power of attorney in the form as prescribed in APPENDIX 11 of the Enforcement Rules to the Personal Information Protection Act shall be submitted to the Company.

제1항에 따른 권리 행사는 정보주체의 법정대리인이나 위임을 받은 자 등 대리인을 통하여 하실 수 있습니다. 이 경우 개인정보보호법 시행규칙 별지 제11호 서식에 따른 위임장을 제출하여야 합니다.

 

⑤ The Information Subject shall not infringe any personal information and privacy of him/herself or a third party which the Company is processing, in violation of the applicable laws including the Personal Information Protection Act.

정보주체는 개인정보보호법 등 관계법령을 위반하여 회사가 처리하고 있는 정보주체 본인이나 타인의 개인정보 및 사생활을 침해하여서는 아니됩니다.

 

⑥ To find out the person in charge of handling requests for inspection, correction or deletion of personal information, please refer to Article 9(2).

개인정보의 열람 , 정정, 처리정지 및 삭제 등의 요청을 위한 담당자는 제 9조 제2항을 참조해주시기 바랍니다.

 

Article 7. Destruction of Personal Information

제7 조 ( 개인정보의 파기)

 

① In principle, the Company shall destroy personal information whose purpose of processing has been achieved.

회사는 원칙적으로 개인정보 처리목적이 달성된 경우에는 해당 개인정보를 파기합니다.

 

② Upon achieving the purpose of processing, personal information of the Information Subjects shall be transferred to a separate DB (in the case of print-outs, separate documentation), which will be immediately destroyed, or stored for a certain period of time as stipulated under the internal guidelines and other applicable laws and regulations and then destroyed. Any personal information transferred to the separate DB shall not be used for purposes other than those originally intended in any event unless otherwise provided under the applicable laws.

정보주체의 개인정보는 목적 달성 후 별도의 DB 에 옮겨져 (종이의 경우 별도의 서류) 내부 방침 및 기타 관련 법령에 따라 일정기간 저장된 후 혹은 즉시 파기됩니다. 이 때 , DB로 옮겨진 개인정보는 법률에 의한 경우가 아니고서는 다른 목적으로 이용되지 않습니다.

 

③ Personal information of the Information Subjects transferred in a separate DB (in the case of print-outs, separate documentation) will only be used for storage purpose unless otherwise specified in the applicable laws.

별도 DB(종이의 경우 별도의 서류)로 옮겨진 개인정보는 법률에 의한 경우가 아니고서는 단순 보유 목적 이외의 다른 목적으로 이용되지 않습니다.

 

④ The Company shall shred or burn print-outs containing personal information. Electronic files containing personal information shall be destroyed in a technical manner that does not allow restoration of the personal information.

회사는 종이에 출력된 개인정보는 분쇄기로 분쇄하거나 소각을 통하여 파기합니다. 전자적 파일 형태의 정보는 기록을 재생할 수 없는 기술적 방법을 사용하여 파기합니다.

 

Article 8. Procurement Measures for the Safety of Personal Information

제8조 (개인정보의 안전성 확보 조치)

 

The Company shall take technical, managerial and physical measures necessary to secure the safety of personal information in accordance with Article 29 of the Personal Information Protection Act as follows:

회사는 개인정보보호법 제29조에 따라 다음과 같이 안전성 확보에 필요한 기술적/관리적 및 물리적 조치를 하고 있습니다.

Article 9. Personal Information Protection Manager

제9조 (개인정보보호 책임자)

 

① The Company has appointed Chief Privacy Officer in order to protect personal information and handle any complaints related to the personal information as follows:

회사는 개인정보를 보호하고 개인정보와 관련한 불만을 처리하기 위하여 아래와 같이 개인정보 보호책임자를 지정하고 있습니다 .

Article 10. Amendment of Personal Information Management Policy

제10 조 ( 개인정보 처리방침의 변경)

 

This Management Policy shall come into effect from the implementation date, and the Company shall give a notice on any insertion, deletion or correction of this Management Policy in accordance with the applicable laws and this Management Policy no later than 7 days prior to the implementation date of such change on News & Notice of the Company’s intranet.

Article 12. Installation and Operation and Denial of aDevice that Collects Personal Information Automatically

제 12조 ( 개인정보 자동수집 장치의 설치, 운영 및 그 거부에 관한 사항 )

① The Company uses cookies. Cookies are files saved on a Information Subject’s computer, which save the record of Information Subject’s visits to the Site(i.e. eShop) and provide such information to the Company. 

회사는 쿠키 (cookie)’를 사용합니다. 쿠키란 정보주체의 컴퓨터에 저장되는 파일로서, 정보주체가 eShop 과 같은 회사의 웹페이지에 방문한 기록을 저장하고 그러한 정보를 회사에 전송합니다.

④ Information Subjects have an option to install cookies.  Information Subjects may accept all cookies or instruct the web browser to send notice when cookies are installed, or refuse to accept all cookies by adjusting the relevant function in the web browser of their own computer.  However, Information Subjects may experience difficulties in using the Company’s services in eShop if they refuse the installation of cookies.
